Atelier or apartment in Bulgaria: what "atelier" status means for address registration, tax, the mortgage and the price

Atelier or apartment in Bulgaria: what "atelier" status means for address registration, tax, the mortgage and the price

In Bulgarian listings the word "atelier" (ателие) often disappears: the property becomes a "studio", a "one-room flat" or an "apartment with a view". The difference is not in the furniture but in the paperwork. An atelier is a non-residential unit, even if it looks exactly like a home, and that affects address registration, the mortgage and how you may use it. Here is what to know before you sign. Verified October 2026.

What an atelier is in law

The Spatial Development Act (ЗУТ) allows the above-ground floors of a residential building to contain, besides dwellings, ateliers and studies for individual creative work (Art. 38(1) ЗУТ). Ordinance No. 7 of 2003 on planning rules and standards (Наредба № 7) also allows ateliers in the roof space (Art. 102(3) of Ordinance 7) and requires each atelier to have its own WC with a washbasin (Art. 102(4)).

The requirements for a dwelling are higher. Every dwelling must have at least one living room, a kitchen or kitchenette, a bathroom with WC and a storage room (Art. 110(1) of Ordinance 7), and a dwelling may not face entirely north, north-east or north-west (Art. 114(2)). That is why north-facing, attic and otherwise awkward units in a building are often designed as ateliers.

"Ateliers count as dwellings" – what that actually means

Since 2021, ЗУТ states that ateliers are treated as dwellings when determining the purpose of the building (§5, items 29 and 29a of the Supplementary Provisions of ЗУТ). Since 23 November 2022, Ordinance 7 says the same (Art. 97(3)). The rule is used to decide whether a building is residential or mixed-use. It does not turn an individual atelier into a dwelling. The unit remains an atelier in the design, in the title deed and in the cadastre.

The law prohibits using buildings or parts of them other than for their designated purpose (Art. 178(4) ЗУТ). In practice many people live in ateliers, but you should know that the legal status does not expressly provide for it.

Address registration

Practice here is inconsistent. In 2021 Sofia Municipality instructed its district administrations not to register residents at "atelier" addresses. At the same time, there are court rulings, including from the Supreme Administrative Court, that overturned refusals and read the concept of "address" under the Civil Registration Act broadly. The takeaway for a buyer: if you will live there and registration matters to you (children, schools, ID documents), ask the district administration before you buy, and do not rely on the seller's assurances.

Building tax and waste fee

It is often assumed that an atelier is taxed "as non-residential" at a higher valuation. Under the Local Taxes and Fees Act (ЗМДТ), the base tax value of an atelier in a block of flats is 100% of that of a flat (Annex 2 to ЗМДТ) – the same base. The rate is set by each municipality between 0.1 and 4.5 per mille (Art. 22 ЗМДТ).

The 50% relief for a main home (Art. 25(1) ЗМДТ) is tied to the property that meets the housing needs of the owner and their family for most of the year (§1, item 2 of the Supplementary Provisions of ЗМДТ). Whether it will be granted for an atelier is a question for the municipal tax office. The waste fee is set by each municipality's ordinance – details in our guide to property tax and the waste fee.

VAT on new builds

The VAT Act does not distinguish between a dwelling and an atelier. Only the supply of buildings or parts of buildings that are not new is exempt (Art. 45(3) of the VAT Act, ЗДДС). If you buy a new atelier from a VAT-registered developer, the price includes 20% VAT (Art. 66(1) ЗДДС) – exactly as with a new flat.

Mortgage

Banks do lend against ateliers, but the terms may differ from those for a dwelling – the maximum loan-to-value, the valuation and collateral requirements depend on each bank's policy. Ask about the specific property before paying a deposit, and remember that the bank's valuer will see "atelier", not "apartment", in the documents. The general rules are in our mortgage guide, and you can estimate the monthly payment with our mortgage calculator.

Price compared with a flat

On the market, ateliers are usually offered for less than a comparable flat in the same building – precisely because of the limitations above. The discount is only real if you know what you are giving up. If you need the property as your own home, with address registration and a loan on standard terms, the lower price may not pay off. As a workspace, a rental investment or a second property, an atelier can be a sensible choice.

Attic and basement units

  • Attic ateliers. Ordinance 7 requires living rooms in the roof space to have a clear height of at least 2.30 m over 50% of their area (Art. 72(4)). Measure the usable floor area – sloping sections count towards the square metres but not towards comfort.
  • Basement units. Under ЗУТ, ateliers in a residential building belong on the above-ground floors, while basement and semi-basement floors are for garages and other non-residential units (Art. 38(1) ЗУТ). If you are offered a "basement atelier" or "basement studio", check exactly what the documents say – it is often a storeroom, office or other non-residential unit with even fewer options for living.

Change of use

An atelier can become a dwelling only if it meets the regulatory requirements for a dwelling (kitchen, bathroom, orientation, etc.) and the change is formally approved under ЗУТ. It is not a formality and is not always possible – do not buy on the assumption that "we'll turn it into a flat later".

What to check in the documents

  • Building permit and approved design – how the unit is designated: "dwelling" or "atelier";
  • Act 16 or the occupancy certificate – what use the unit was approved for (for the new-build acts, see our guide);
  • Cadastral plan – the designated use of the unit;
  • Seller's title deed – does it match the above;
  • Preliminary contract – is the unit described accurately as an "atelier" rather than an "apartment".

This article is general information, not legal or tax advice for a specific case.

If you are weighing an atelier against a flat, call us or visit our office – we will go through the documents and tell you exactly what you would be buying.
