Many buyers choose a plot for the view and the price per square metre. Later they find out that the house they had in mind cannot be built there, or that bringing in power and water will cost half as much as the shell. Here is what to check before you pay a deposit.
The general legal checks on ownership (documents, encumbrances, co-ownership) are covered in our guide to legal checks before buying. This guide covers what is specific to a building plot.
Regulated plot or farmland
A regulated plot (УПИ) is one for which the detailed development plan (ПУП) has set boundaries, access from a street or road, a specific use and planning rules (§ 5(11) of the Spatial Planning Act, ЗУТ). Only on such a plot can you go straight to design and construction.
Agricultural land, even right next to the last house in a village, first needs a change of designation under the Agricultural Land Protection Act (ЗОЗЗ). In short, the procedure works like this:
- A detailed plan is drawn up and approved for the plot.
- A proposal goes to the commission under Art. 17(1) of the Act.
- The commission decides and sets a fee under Art. 30.
- The decision takes effect only once the fee is paid.
This takes time, costs money and is not guaranteed, so the price of such land should reflect the risk.
Check the minimum dimensions too. For low-rise housing, Art. 19 of the Spatial Planning Act requires, for example, at least 14 m of street frontage and 300 sq m in towns and 16 m and 500 sq m in villages on flat terrain. In some cases these can be reduced by at most one fifth.
The detailed plan and the design visa
Ask the seller for an extract from the detailed plan and, ideally, a design visa (виза за проектиране, Art. 140 of the Spatial Planning Act). The visa is an extract from the current plan covering your plot and its neighbours. It shows the building lines, the permitted height, density and floor-area ratio, and any other requirements.
- The municipality's chief architect issues the visa within one month of the application (Art. 140(7)).
- In most cases a visa is optional. It is mandatory only in cases the law lists. For low-rise housing, design can start on the basis of a visa (Art. 140(5)).
- Under Art. 140a you can request, together with the visa, the grid and water operators' technical data for connection. The operators provide them free of charge within 14 days.
What the planning parameters mean
| Parameter | What it means | Example on 600 sq m |
|---|
| Density (плътност) | Ground footprint as a percentage of the plot | 60% → up to 360 sq m footprint |
| Floor-area ratio (Кинт) | Gross floor area of all above-ground storeys relative to the plot area | 1.2 → up to 720 sq m gross |
| Green space | Minimum share of the plot that stays green | 40% → at least 240 sq m |
| Height | Maximum height or number of storeys | e.g. 10 m (3 storeys) |
For a low-rise residential zone (Жм), Ordinance No. 7 on planning rules and standards sets upper limits: density 60%, floor-area ratio 1.2, green space at least 40% and height up to 10 m. The specific detailed plan may set lower values, so your plot's extract is what counts, not the general rule.
Road, power, water, sewer
- Access: a regulated plot must front a street or road under the plan. Check that the road actually exists and who owns it, not just that it is drawn on the plan.
- Power and water: the operators' technical data and connection terms show where the nearest connection point is and what you will have to build. If the design is not submitted for approval within one year of the visa, new technical data are needed (Art. 140a(8)).
- Sewer: without a public sewer you need another solution for wastewater. In registered landslide areas, building without a sewer is not permitted (Art. 87(5) of the Spatial Planning Act).
Ground conditions, landslides, easements
- Landslides: the regional development ministry keeps a register of landslide areas through the state geo-protection company (Art. 95(2) of the Spatial Planning Act). In a registered area, construction requires prior consent from the minister and meeting extra conditions (Art. 96(4)). Check before you buy.
- Geotechnical survey: on sloping land, made ground or a high water table, it can change the foundations and the budget.
- Easements: overhead power lines and water or gas mains crossing the plot restrict building within a set zone around them. Check the cadastral map and on site.
Cadastre and Property Register
Compare the cadastral map extract (from the cadastre agency, АГКК) with what you see on the ground: boundaries, fences, area. Check that the owner in the cadastre matches the seller. In the Property Register (Registry Agency) check for mortgages, attachments and registered claims.
Transaction costs (indicative)
- Local acquisition tax: 0.1% to 3%, set by each municipality. Sofia charges 3%.
- Registration fee: 0.1%.
- Notary fee: set by a statutory tariff based on the value of the deal. Estimate it with our notary calculator.
- VAT: the sale of a regulated plot by a VAT-registered seller is a taxable supply. Check whether the price includes VAT. The proposed VAT registration rule for sellers of plots is covered here.
A realistic path to a building permit
- Before the deposit: plan extract, cadastral extract, Property Register check and landslide register check.
- Design visa with the operators' technical data under Art. 140a. You can apply before completion, with the owner's consent.
- Topographic and geotechnical surveys.
- Investment design. You sign a written contract with a designer. The design goes to the municipality with the documents listed in Art. 144.
- Design approval: within 14 days if a consultant has assessed compliance, otherwise within one month (Art. 144(3)).
- Building permit: issued by the chief architect within 7 days of an approved design (Art. 148(4)). You can also request it together with approval.
- Deadlines: the permit lapses if work does not start within three years, or if the shell is not finished within five years of starting (Art. 153(2)). It can be renewed only once.
